On Frankfurt's view of free will, in its simplest form, an agent is free just in case her second-order volitions -- those second-order desires she wishes to be effective -- are in accord with her first-order volitions -- those first-order desires that one actually acts upon. That is, an agent has free will just in case she has the desires she wants to have and they are the desires she acts upon. But now consider an agent who lacks free will (...) because her first-order volitions and second-order volitions conflict. Suppose also that, with enough therapy, she could alter her first-order volitions to be in accord with her second-order volitions. So it is true that she can alter her first-order volitions. Still, there is the question of what she should she do. A natural response that a real self theorist might make is that the agent should change her first-order volitions in order to reflect her second-order volitions. But this is not, in principle, the only option available to our agent. Instead of changing her first-order volitions to reflect her second-order volitions, she might also consider simply revising her second-order volitions to fit with her first-order volitions. In fact, since second-order volitions are arguably more reasons responsive, it could turn out for our agent that changing her second-order volitions is actually the most rational option to take. This applies to even the most recent developments of real self, hierarchical, reasons responsive, and even intention embedded accounts of free will. Indeed, there is empirical evidence that people change their conceptions of themselves quite readily in the face of cognitive dissonance of the kind faced by desire conflicts. But this way of attaining free will does not seem to comport with our conception of a free agent. Free will seems too easy to obtain if all that is required is that our second-order volitions are in accord with our first-order volitions, and I see no particularly principled way of arguing that we shouldn't consider changing our second-order volitions instead of changing our first-order volitions. Secondly, this conception of free will is also subject to other counter examples. A person, for instance, may not be able to respect hierarchies due to some personality trait or other, but she might also be the kind of person for whom even were this trait lacking, still would not want to respect hierarchies. Here we have case in which a person's first order volitions and second order volitions coincide, but we do not want to call her free either. Additional evidence that this cannot be the right conception of free will comes from ideas put forth in the literature on practical rationality: I can be in situations in which the only rational action for me to take is to change my desires (MacIntosh), but if we cannot make irrational decisions, and these are understood as decisions to act in ways that go against our current desires, then being in a situation in which I choose to change my current desires should not be possible, thereby challenging any conception of free will that requires the changing of desires, whether first-order or second-order. I conclude, then, that any compatibilist conception of free will of the kind mentioned will be ultimately unsatisfying. (shrink)

This article describes the conceptual framework within which knowledge about Africa was legitimized in eighteenth-century French philosophy. The article traces a shift or rupture in this conceptual framework which, at the end of the eighteenth century, led to the emergence of new conditions for knowledge legitimation that altered Europe's perception of Africa. The article examines these two conceptual frameworks within the context of a discussion of the social theory of the time, which categorized Africans first as savages, and then, with (...) the advent of our modern "style of reasoning," as primitives. The argument used to demonstrate this change in categorizations is historical. The greater part of the article analyzes in detail the principal social theory of Enlightenment philosophy, the stadial theory of society, with the aim of demonstrating how it determined what could be affirmed about Africa. The shift in the perception of Africans from savages to primitives involved an epistemological change in how societies were grasped. The article provides a greater understanding of the constitution of Africa as a cognitive construct, which is not only of theoretical concern; this construct shaped Europe's intervention in Africa, and continues to influence what we believe Africa is and should become. Historically, treatment for pain relief has varied according to the social status of the sufferer. A similar tendency to make arbitrary distinctions affecting pain relief was found in an ethnographic study of animal research laboratories. The administration of pain-relieving drugs for animals in laboratories differed from standard practice for humans and, perhaps, for companion animals. Although anesthesia was used routinely for surgical procedures, its administration was sometimes haphazard. Analgesics, however, were rarely used. Most researchers had never thought about using analgesics (...) and did not consider the subject worthy of serious attention. Scientists interviewed for this study agreed readily that animals are capable offeeling pain, but such assertions were muted by an overriding view of lab animals as creatures existing solely for the purposes of research. As a result, it was the exceptional scientist who was able to focus on anything about the animal's subjective experience that might lie outside the boundaries of the research protocol. (shrink)

T. A. Cavanaugh defends double-effect reasoning (DER), also known as the principle of double effect. DER plays a role in anti-consequentialist ethics (such as deontology), in hard cases in which one cannot realize a good without also causing a foreseen, but not intended, bad effect (for example, killing non-combatants when bombing a military target). This study is the first book-length account of the history and issues surrounding this controversial approach to hard cases. It will be indispensable in theoretical ethics, applied (...) ethics (especially medical and military), and moral theology. It will also interest legal and public policy scholars. (shrink)

Cavanaugh's Hippocrates' Oath and Asclepius' Snake: The Birth of the Medical Profession articulates the Oath as establishing the medical profession's unique internal medical ethic - in its most basic and least controvertible form, this ethic mandates that physicians help and not harm the sick. Relying on Greek myth, drama, and medical experience (e.g., homeopathy), the book shows how this medical ethic arose from reflection on the most vexing medical-ethical problem -- injury caused by a physician -- and argues (...) that deliberate iatrogenic harm, especially the harm of a doctor choosing to kill (physician assisted suicide, euthanasia, abortion, and involvement in capital punishment), amounts to an abandonment of medicine as an exclusively therapeutic profession. The book argues that medicine as a profession necessarily involves stating before others what one stands for: the good one seeks and the bad one seeks to avoid on behalf of the sick, and rejects the view that medicine is purely a technique lacking its own unique internal ethic. It concludes noting that medical promising (as found in the White Coat Ceremony through which U. S. medical students matriculate) implicates medical autonomy which in turn merits respect, including honoring professional conscientious objections. (shrink)

The deontologist J. J. Thomson disagrees. She asserts that Anscombe mistakes the distinction’s moral import; it bears on agent-evaluation, not act-evaluation. I map out the contours of this dispute. I show that it implicates other disagreements, some to be expected and others not to be expected. This is a condensed description of the contents and overarching argument found in Hippocrates’ Oath and Asclepius’ Snake: The Birth of the Medical Profession. In that work, I maintain that the basic medical ethical problem concerns iatrogenic harm. I focus particularly on what I refer to as ‘role-conflation’. This most egregious form of iatrogenic harm occurs when a physician deliberately adopts the role of wounder. A contemporary practice such as physician-assisted suicide exemplifies a doctor’s deliberate wounding. I argue that the (...) author of the Hippocratic Oath – aware of the chronic risk of role-conflation – responds to this threat by having the oath-taker specifically forswear signal acts that wound the sick, such as giving a deadly drug even if asked, giving an abortifacient, sexual predation, and gossiping. I argue that by means of the Oath, Hippocrates founds medicine as a profession, a practice intimately involving promising. (shrink)

In this essay I articulate Aristotle’s account of the voluntary with a view to weighing in on a contemporary ethical debate concerning the moral relevance of the intended / foreseen distinction. Natural lawyers employ this distinction to contrast consequentially comparable acts with different intentional structures. They propose, for example, that consequentially comparable acts of terror and tactical bombing morally differ, based on their diverse structures of intention. Opponents of double-effect reasoning hold that one best captures the widely acknowledged intuitive appeal (...) of the distinction by contrasting agents, not acts. These thinkers hold that the terror bomber differs from the tactical bomber while terror bombing does not differ ethically from tactical bombing. Aristotle’s accounts of the voluntary and the deliberately decided upon provide grounds for the ethical relevance of the intended / foreseen distinction as applied to both acts and agents. (shrink)
